The main provisions of the Environment Act 1995 ("the Act"), are as follows:-

Environment Agencies

The creation of Environment Agencies - Part I of the Act, sets up two new bodies namely the Environment Agency (England and Wales), and the Scottish Environment Protection Agency.
The two respective Environment Agencies now encompass
- The National Rivers Authority (England and Wales)
- The River Purification Authority (Scotland)
- The Waste Regulation Authorities
- Her Majesties Inspectorate of Pollution
Functions and Duties

The Agencies functions and duties include:-
- Compiling information on the pollution of the environment
- Assessing the effects of pollution of the environment
- Investigating the options for mitigating the effects of pollution
- Conservation of the beauty of land and waterways
- Maintenance of fisheries
- Carry out cost-benefit analysis when exercising its powers
- Conservation of water resources
Section 57
The new contaminated land regime - Section 57 of the Act, ammends Part II of the Environmental Protection Act 1990, by introducing new provisions as regards contaminated land. There are 27 paragraph headings which include:-
- Definition of Contaminated Land
- Which Authority is responsible for regulation
- Serving of remediation notices
- Issuing of remediation declarations
- Definition of a responsible person
- Apportioning liability
- Tripartite Sampling
- Enforcement Powers
Section 80
- Set air quality standards
- Restrict the presence in the air of certain contaminants
- Restrict access of vehicles to prescribed areas
- Allocate new powers and duties on Local Authorities.
EC Directive 94/62
Producer responsibility - with the aim of increasing the recycling of packaging waste significantly, with EC Directive 94/62 being the target to be attained.
